California becomes first 'sanctuary state' for undocumented migrants

Los Angeles (AFP) - California became the first "sanctuary state" for undocumented immigrants Friday, a decision criticized by the Trump administration which believes the move will compromise security.

California's governor, Democrat Jerry Brown, signed the landmark legislation -- Senate Bill 54 (SB54) -- which grants better protections to people who are in the US without permission, including those who have committed crimes.

It also limits cooperation between local police forces and federal authorities in operations to track down undocumented immigrants.

The legislation, which will come into effect on January 1, 2018, is part of a series of laws which protect the almost 3 million undocumented immigrants living in California -- most of whom are from Mexico and Central America.

Brown insisted in his signing statement the measure will not "prevent or prohibit Immigration and Customs Enforcement (ICE) or the Department of Homeland Security from doing their own work in any way" -- but it will stop local authorities from assisting.

"They are free to use their own considerable resources to enforce federal immigration law in California," he wrote, adding that the new legislation will not deny ICE access to prisons.

But in a statement, ICE acting director Tom Homan responded: "The governor is simply wrong."

The law will "undermine public safety and hinder ICE from performing its federally mandated mission," Homan said.

"Ultimately, SB54 (...) creates another magnet for more illegal immigration," he insisted, adding ICE will have "no choice but to conduct at-large arrests in local neighborhoods and at worksites, which will inevitably result in additional collateral arrests."

ICE said it will also likely send immigrants arrested in California to detention centers outside of the state, "far from any family they may have in California."

A number of cities in California, such as Los Angeles and San Francisco, have already banned police officers from collaborating with ICE on operations to capture undocumented immigrants.

Last week, ICE detained 450 undocumented immigrants in the United States -- 101 of whom were in Los Angeles.

The bill signed into law by Brown also includes assistance for students and measures to combat abuse of tenants.

How so?

It's illegal for States to make laws that supersede the federal government's. So legally, ICE can keep working in California and could actually arrest state officials who impede them if they wanted to.

I'm assuming he's referring to federal law. In the same way that technically weed is still illegal and technically the feds could raid every single shop in Cali and shut them down. Federal law ultimately gets top billing and is supposed to take precedent above state law.
They just generally don't because it would be a shit storm if they stepped over states law like that.

If California gets a mass deporation.. I can tell you that U.S's economy will plummit and food will go up lot. You can hate illegals as much as you want, but they do contribute a lot to the economy while getting exploited at the same time.

How many options do illegal people have? Not many. They want a job, they take it for low salary because there are 10 other guys wanting to take it for the same price. 

They aren't making minimum wage, they live a bunch of people to one house to save money and return some to home, and they are extremely expendable.

No. You're correct. My validation or approval isn't required. But the laws of the country I live in is required.

Texas California Florida and New York combined, account for 1/3 of the entire USA GDP. They all have a high amounts of illegals and yet happen to be the most prosperous states in the nation. You cant say illegals hold back the country because thats not economically true as long as we rid criminals. Politicians know this. The only reasonable argument you make against illegals is that it's illegal.

I believe so. As I understand it, Sanctuary Cities (or a State in this case) would simply not have the state agencies assist in deportation.

    1. Local police are REQUIRED to enforce the law, be it local, state, or federal. If a local cop busts you for interstate racketeering, you don't just walk because it's a federal crime.

    2. Being asked to provide proof of identity isn't profiling.

    The didn't even read the article, did you? It literally points out the law only prevents local and state law enforcement from helping the Feds, and that they can't stop the Feds.

    Wrong. Not only are local cops not required to enforce Federal laws, they are no more able to enforce Federal laws than any other random citizen.
