DSP is going to jail for tax evasion

Reddit thread posted by DSP himself asking for tax advice:
https://www.reddit.com/r/legaladvice/comments/6yox5p/irs_auditing_me_for_the_past_three_years/

[Washington] I was sent a letter from the IRS telling me that I'm being audited for 2016,2015 & 2014.

I'm a YouTuber so i claimed lots of things as buiness expenses. My car, my office, my filming equipment and computers.

I've claimed lunches with other YouTubers as buiness lunches because that's what they are. Taxaudit.com is helping but they are telling me the IRs needs the details about what was discussed at these lunches in 2014 (i have no idea). They've requested receipts for equipment i bought that year and i don't have them. No one told me i needed to save them. I provided them with credit card statements and that's not enough. I feel like I'm being charged as guilty without a trial. I stand to owe them as much as 300k. I could lose most everything i own.

who was in the wrong here?

People are jerks to DSP because he's a jerks himself. The dude treats his fans like garbage, can't admit any of his own faults, constantly has belittled and screwed over fans, his friends, and even business partners. All of his issues now are literally his own doing.

Yeah it sucks for the guy that he's about to lose everything but DSP has a horrible reputation. Whether his whole be a douche online thing act or not the guy is legit a moron. Sorry if I don't feel bad for him.

I love DSP. Every time it seems like he's bottomed out, he just goes deeper and deeper.

What I hate is when people try to say it's all on purpose, because I feel like they don't understand just how much credit they're giving the guy with statements like that. He's alienated friends, employers, and the few diehard fans with his attitude, and if even half the stuff he says about his failing personal life is true (like moving into a gated community, leasing a BMW, etc), then Darksydephil is the greatest social experiment of our time.

Or he's just a huge moron. What sounds more likely?

And also, there is one more thing about DSP being an act I don't understand; the dude has been consistently losing viewes since like 2013 because of his attitude. So even if it has been an act, it's not a successful one so I don't get it.

You don't go about making that amount of money and claiming that much in expenses without a very firm understanding of what you're allowed to do and without a half decent accountant. This guy was trying to rinse the system and got busted, that much is very obvious.

Even if he did do all of this unknowingly, he's still at fault. The IRS don't go out of their way to audit people for s***s and giggles.

Moreover, has anyone questioned how a guy who works from home has any claim to his car being a business expense?

I wouldn't be surprised if "business expenses" constituted the most tax fraud overall.

By instances, not necessarily amount of money.

No, I'm fairly certain just straight up not paying your taxes is the biggest one.

It's 54 cents per business mile driven for 2016 that you can deduct.

Or add up all the other auto expenses (insurance, gas, lease payments, repairs & maintenance, vehicle tax) then multiply it by total business miles/total miles

Whichever is higher you can deduct (Source: I'm a CPA).

Can also confirm that this idiot should have hired someone..

      How is it paid for?

well you yourself pay for the transaction, but if the transaction is for business purposes you can deduct the expense as a cost of business to reduce your net profit - which is what you pay taxes on. Unless you buy equipment or other big stuff, then you have to take the deductions in small parts every year for a certain number of years. In the tax world, this is known as depreciation. Depreciation doesn't mean something is less valuable over time, it's a way to allocate costs.

Even if you aren't going to retain their services for tax prep every year. You should still try to at least get a good understanding of what you need to be doing.

      https://www.reddit.com/r/legaladvice/comments/6yox5p/irs_auditing_me_for_the_past_three_years/

I feel bad for the guy but how was he never taught that he needs to save his receipts and keep note of things like that for years just to be safe? Just because they don't audit you this year doesn't mean you're in the clear.

I'm not blaming him, I'm sure a lot of people don't save their receipts and stuff, I just wish financial education was mandatory in schools these days. If your parents don't teach you before adulthood you can easily screw yourself without even realizing it.
You look EXTREMELY immature when you announce that you're about to ignore someone. No one cares, including the person about to be ignored. Just FYI.

You only get audited if you claim itemized deductions like business expenses. (Generally)

However, it's a good idea for insurance purposes if you are ever robbed.

Saving receipts is a good practices, because you should double check your credit card bill to make sure there are no random charges.

But you don't need to unless you are trying to claim deductions with what you brought.

I was honestly wondering how long before something like this finally came up. Government is slow to adapt to the shifting pace of technology, & I was certain our tax laws weren't truly prepared to the Youtuber business model. Combine that the average Youtuber personality probably isn't too business savvy, & more likely just some average person who has managed to strike it bigger than they probably ever truly anticipated, & this was inevitable.
